Terms of Use

1. Parties and scope

These Terms of Use (the "Agreement") govern the use of the Workigom Flow mobile app and web dashboard (the "Service"). The Service is provided by Volkan Akbulut (sole proprietorship, under the "Workigom" brand), contact: info@workigom.com.

By creating an account, installing or using the app, you accept this Agreement and the Privacy Policy. If you do not accept them, do not use the Service.

If you use the Service on behalf of a business, you represent that you are authorised to bind that business.

2. The Service

Workigom Flow lets you manage appointments, customers, finances (income-expense and invoice reading), social media and WhatsApp customer communication with AI assistance. Features may be added, changed or removed over time.

3. Account and security

You must be at least 18 years old to use the Service.

You are responsible for the accuracy of your account information, the confidentiality of your password and everything done under your account. Notify us immediately if you suspect unauthorised use.

You may not transfer, sell or share your account. You are responsible for the access you give to your staff.

4. Acceptable use

You may use the Service only for lawful purposes and in line with this Agreement. The following are prohibited: creating, uploading or sending content that is unlawful, deceptive, abusive, hateful or that infringes the rights of others (intellectual property, personality rights, personal data); sending unsolicited commercial messages (spam) or bulk unwanted messages; impersonating others; attempting to disrupt the security, integrity or performance of the Service or its servers; attempting unauthorised access to accounts; sending automated requests that overload the Service.

5. Intellectual property and licence

The Service, including its software, source code, design, interface, texts, AI prompts, database structure, trademarks, logos and all other elements, belongs to Workigom and is protected by intellectual property laws. This Agreement does not transfer any of these rights to you.

For the term of this Agreement, Workigom grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right to use the Service for your own business activities. No right of access to source code is granted.

6. Prohibited actions (reverse engineering, copying, etc.)

Except where applicable law expressly permits, you may not, and may not allow or attempt to, without Workigom's written permission:

• reverse engineer, decompile or disassemble the Service (app, web dashboard, server components, APIs), or analyse its network traffic, in order to obtain or extract source code;

• copy, reproduce, adapt or modify the Service or any part of it, or use it to create derivative works or a competing product or service;

• sell, rent, lend, sublicense, distribute, republish or make the Service available to third parties;

• scrape or bulk-copy the interface, database, AI prompts, response formats or product content using automated tools (bots, crawlers, scraping);

• circumvent or disable licensing, access, security, usage-limit or authentication measures, or introduce malicious software;

• use outputs obtained from the Service's AI components to develop or train an AI model or product that competes with Workigom;

• use the Workigom or Flow name, brand or logo without permission.

Violation of these provisions may lead to immediate suspension or termination of your account and to legal and criminal proceedings.

7. Your content and data

Content and data you upload or enter into the Service (customer records, appointments, invoices, posts, messages, etc.) belong to you. You allow us, to the extent necessary to provide the Service, to host and process them and, on your instruction, to pass them to AI and connected service providers.

When you enter personal data of your customers and other people into the Service, you are the data controller; you are responsible for meeting notice obligations and for having a lawful basis and any required consent. How data is processed is explained in the Privacy Policy.

8. AI features

The Service uses AI for text, images, replies and data reading. AI output can be wrong, incomplete or inappropriate. You are responsible for checking important outputs such as invoice/receipt reading results, amounts, VAT, dates, customer replies and social media posts before approving, sending or publishing them.

The Service does not provide accounting, tax, legal or medical advice. The accuracy of your bookkeeping and tax returns is the responsibility of you (and your accountant).

If you come across inappropriate or incorrect AI output, you can report it to info@workigom.com.

9. Third-party services

The Service may work with third-party services such as WhatsApp, Meta (Facebook/Instagram), Google (YouTube, Gemini, Calendar, etc.) and other social networks. You are responsible for complying with those parties' own terms, policies and messaging/automation rules.

The rules and availability of these services (account restrictions, API changes, outages, etc.) are controlled by those third parties; Workigom is not responsible for their consequences. Workigom is not affiliated with or endorsed by these companies.

10. Fees, subscription and cancellation

Some features of the Service may require a paid subscription. Plans, prices, trial periods and payment terms are stated separately at the time of purchase and apply as stated. Subscription payments may be collected through the website.

You may cancel your subscription at any time; cancellation takes effect at the end of the current period. Your statutory withdrawal and refund rights remain unaffected. We reserve the right to change prices and plans; changes apply from the next period and are announced in advance.

11. Availability

We do not promise that the Service will be uninterrupted or error-free. The Service may be temporarily unavailable due to maintenance, updates, third-party outages or force majeure. We may change, limit or discontinue features; we try to announce significant changes a reasonable time in advance.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available". No express or implied warranty is given as to fitness for a particular purpose, freedom from errors or uninterrupted operation.

13. Limitation of liability

To the extent permitted by applicable law, Workigom is not liable for indirect, incidental or consequential damages, for loss of profit, revenue, reputation, data or business, or for damage arising from third-party services or from decisions made in reliance on AI output. Our total liability is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim.

Liability for intent and gross negligence, and any liability that cannot be limited or excluded by law, remains unaffected.

14. Indemnity

You agree to compensate Workigom for damages and costs (including reasonable attorney fees) arising from third-party claims caused by your breach of this Agreement, of the law or of third-party rights, or by content you upload.

15. Suspension and termination

You may delete your account at any time in the app or the web dashboard (Profile page → Delete my account). We may suspend or terminate your account if you breach this Agreement, threaten security, or a legal obligation arises. On termination your right to use the Service ends; retention and deletion follow the Privacy Policy. Provisions that by their nature must survive (intellectual property, prohibited actions, liability, indemnity, governing law) remain in force after termination.

16. Changes

We may update this Agreement. We announce significant changes in the app or web dashboard; the current version is always on this page. Continuing to use the Service after a change means you accept the current Agreement.

17. Governing law and jurisdiction

This Agreement is governed by the laws of the Republic of Türkiye. The Istanbul (Anatolian) courts and enforcement offices have jurisdiction. Mandatory provisions of consumer law (including the jurisdiction of consumer arbitration committees and consumer courts) remain unaffected.
